Unfair Competition

Protecting know-how, customers and corporate reputation

When competition is unfair, it is no longer a challenge: it is harm.

Unfair competition is one of the most insidious phenomena for businesses, often difficult to prove but capable of causing enormous financial, strategic and reputational damage. In many cases, the harm comes from within: former employees, shareholders, consultants or associates who, in breach of agreements or rules, reuse confidential information, take customers or replicate business models in conflict with the original company.

Global Risk Intelligence supports businesses with dedicated investigations to establish acts of unfair competition, collect documented evidence and provide practical support for legal, disciplinary or injunctive action. We operate discreetly and in compliance with regulations, undertaking strategic monitoring, mobile observation and the collection of OSINT and witness evidence, including in highly confidential environments or regulated sectors.

Our aim is to reconstruct precisely the unlawful conduct, intent, extent of the harm and persons involved, providing the client with an operational and legal tool to respond, defend itself or prevent the violation from recurring.

What we can verify

  • Theft and unauthorized use of customer databases or price lists
  • Establishment of new companies in conflict with a former employer
  • Breach of non-compete, confidentiality or exclusivity agreements
  • Use of confidential documentation, know-how or protected materials
  • Unlawful contact with established company customers or suppliers
  • Starting parallel activities by employees who are still employed
  • Commercial defamation and online reputational sabotage
  • Concealed collaboration between competitors and company insiders

When to initiate the investigation

At the end of an employment relationship with key personnel (sales staff, executives, technicians)

If a competing company is suspected of having been established by former employees

When there is a sudden, suspicious loss of customers or recurring orders

In cases of unusual behavior, improper data access or file transfers

To support legal action or an urgent application for interim relief

Case Study: Unfair Competition

An industrial group reported a suspicious reduction in orders from three longstanding customers. The investigation revealed that a former salesperson, who had resigned a few months earlier, had started a new competing company with a supplier and was reusing price lists and contacts obtained at the company. GRI provided photographic, corporate and digital evidence that enabled the client to initiate unfair competition litigation and rapidly stop the harmful effects.
